A physician operating a pain management practice in Law Cruces, New Mexico has plead guilty to federal charges after admitting to illegally prescribing painkillers without legitimate medical need. According to court records, his misconduct led to the death of one woman, although he initially faced charges in connection with at least three other deaths.

The doctor’s medical license was revoked in December 2012. He is currently in federal custody pending a sentencing hearing to determine punishment for two counts of unlawful distribution of a controlled substance and healthcare fraud. Prior to accepting the plea deal, the doctor faced 136 criminal charges and faced penalties of up to 30 years in prison and $1.25 million in fines. Now, he only faces between 3.5 and nine years in prison, along with a term of supervised release.
The death addressed in the two charges involved two prescriptions for methadone given to a patient after only a cursory evaluation, and without actual medical need. Both prescriptions were wrongfully submitted to Medicare for reimbursement. The patient died only two days after filling the second prescription.
